Version 1.1 · Effective 1 November 2026 · Bobo Campers (Pty) Ltd, registration number 2024/789918/07

Key Terms Notice

Please read this notice before you pay. It summarises the terms that most affect your money and your safety. The full terms are in the Agreement below and in the Annexures; if anything here differs from them, the full terms apply.

#What you need to knowWhere
1You are responsible for the vehicle. From collection until we accept its return, you are responsible for loss of or damage to the vehicle, up to the excess for the CDW you choose.Clauses 18–19
2Your excess. Basic (included): R65,000 per incident. Midi: R30,000 per incident. Maxi: nil. The excess is the most you pay for a covered incident. We pre-authorise it on your credit card at collection and charge it in full when damage is reported; if the repair costs less, we refund the difference.Annexure 2
3When the CDW does not apply. If a serious exclusion applies, the CDW falls away whatever option you chose, including Maxi, and you pay up to R65,000 per incident. Examples: driving under the influence; driving at night (other than short local trips allowed by clause 12.9); an unauthorised driver; driving in a prohibited country or on a prohibited road; deliberate damage; or giving us false information.Clause 20
4Never covered by any CDW option. Water damage; towing and recovery after an accident you cause; equipment and accessories; and your personal belongings. Tyres and windscreens are covered only by Maxi. Overhead and underbody damage are covered by Maxi; on Basic and Midi you pay up to your excess. Your vehicle’s height is shown in Annexure 4 and explained at handover.Clause 20.4
5Roll-overs. A roll-over caused by driver error or on a prohibited road means the CDW does not apply, and you pay up to R65,000.Clause 20.3
6Excess held on your card. On Basic (R65,000) and Midi (R30,000) we pre-authorise your excess on your credit card at collection; nothing is held on Maxi. The hold is released after return unless there is damage or another charge. Fuel, cleaning, fines and other charges can still be charged to your card.Clause 11
7Payment and cancellation. 50% to confirm, balance 30 days before collection. Cancellation charges increase as your collection date approaches.Clauses 5 and 7
8Where you may drive. Each vehicle has permitted countries and road types. Crossing a border needs our written approval in advance.Clauses 14–15, Annexure 4
9Accidents and breakdowns. Call the 24-hour assistance number for your depot at once (Johannesburg +27 82 940 0984; Cape Town +27 82 908 1252; Windhoek +264 81 141 2975). Report every accident to us and to the police within 24 hours; if you do not, the CDW may not apply. Do not authorise towing or repairs over R1,200 without our approval.Clauses 16–17
10Personal injury and belongings are not covered by any CDW option. We strongly recommend travel and medical insurance.Clause 22

Part 1 — Master Terms and Conditions of Hire

1. About this Agreement

1.1 These Terms are issued by Bobo Campers (Pty) Ltd (registration number 2024/789918/07), 32 Stanley Road, Norton’s Home Estates, Benoni, Gauteng, 1620, South Africa (“Bobo“, “we“, “us“), part of the Nomadii Group.

1.2 The Agreement between you and us consists of the following documents, which are all binding:

  1. the Rental Agreement (Annexure 1), which records the details of your rental;
  2. these Master Terms, including the Key Terms Notice;
  3. the Collision Damage Waiver (CDW) Schedule (Annexure 2);
  4. the Fees and Charges Schedule (Annexure 3);
  5. the Vehicle Usage and Territorial Schedule (Annexure 4); and
  6. the completed Collection and Return Checklist (Annexure 5).

1.3 Order of precedence. If documents conflict:

  1. the Rental Agreement prevails on the details of your rental (vehicle category, dates, locations, price, CDW level and Excess) and on any special condition written in it and signed by both parties;
  2. otherwise, these Master Terms prevail over the Annexures; and
  3. a quotation, website description, brochure or the Quick Reference Guide never overrides the Agreement.

1.4 Version that applies. The Annexures in force on the date your booking is confirmed apply to your rental. If we publish a later version, it applies to your booking only if it is more favourable to you or you agree to it in writing. Each Annexure shows its version number and effective date.

1.5 Consumer rights. Nothing in this Agreement limits any right you have under the Consumer Protection Act 68 of 2008 (“CPA“) or other law that cannot lawfully be limited. Where a clause could be read in more than one way, the reading most favourable to you as a consumer applies.

1.6 Plain language. We have tried to write this Agreement so that it is easy to understand. Headings and examples are there to help you and do not change the meaning of a clause.

2. Definitions

In this Agreement:

  • Additional Driver — a person, other than the Renter, named in the Rental Agreement as authorised to drive.
  • Authorised Driver — the Renter, if the Renter is a natural person who will drive, and each Additional Driver.
  • Booking — a reservation we have confirmed in writing after receiving the booking deposit.
  • Booking Confirmation — our written confirmation of a Booking, stating the booking reference, vehicle category, dates, locations and price.
  • Business Day — any day other than a Saturday, Sunday or public holiday in the country of the relevant depot.
  • Collection — the moment you sign the Rental Agreement and take possession of the Vehicle.
  • Damage — physical loss of or damage to the Vehicle, including theft or attempted theft.
  • CDW (Collision Damage Waiver) — the Basic, Midi or Maxi option described in Annexure 2, by which we waive our right to recover from you the cost of Damage above the Excess, on the terms of this Agreement.
  • Depot — our Johannesburg, Cape Town or Windhoek branch listed in Annexure 3.
  • Excess — the maximum amount you must pay us per Incident for Damage, as set out in Annexure 2. The Excess for your CDW level is pre-authorised on your credit card at Collection (clause 11).
  • Incident — a single event, or a series of events with one cause, that results in Damage.
  • Rental Period — from Collection to the time we accept the Vehicle back under clause 24, including any extension we agree.
  • Rental Charges — the daily rental, CDW charges, extras and fees payable under the Booking Confirmation and Annexure 3.
  • Renter or you — the person or entity named as renter in the Rental Agreement.
  • Serious Exclusion — an event listed in clause 20.2.
  • Vehicle — the motorhome or camper described in the Rental Agreement, with its keys, documents, tools, equipment and accessories listed in the Collection Checklist, and any replacement vehicle.
  • Vehicle Category — the class of vehicle booked, for example Discoverer-4, Discoverer-6 or FunXA 4×4.

3. Bookings

3.1 Enquiries and quotations. A quotation is an offer to hold a price until the date shown on it. It does not reserve a vehicle.

3.2 When a Booking is made. A Booking is made when (a) you have accepted these Terms (online or in writing), (b) we have received the booking deposit under clause 5, and (c) we have sent you a Booking Confirmation.

3.3 Online bookings. Before you pay online you will be shown the total price, the Key Terms Notice and these Terms, and you must tick to confirm you have read and accept them. We keep an electronic record of your acceptance. Your Booking Confirmation will include a copy of, or a link to, the version of the Terms that applies.

3.4 No cooling-off period. Because we undertake to provide the Vehicle for specific dates, the seven-day cooling-off right under section 44 of the Electronic Communications and Transactions Act 25 of 2002 does not apply. You may still cancel under clause 7.

3.5 Bookings through a travel agent or tour operator.

  1. Where you book through an agent, the agent acts on your behalf in making the Booking. Your contract for the rental is with us, on these Terms.
  2. The agent must give you these Terms and the Key Terms Notice before you pay. If you did not receive them, you may cancel without charge on receiving them, provided you do so before Collection and within 3 Business Days. Any cancellation charge that would otherwise have applied is then payable by the agent, not by you (Annexure 6).
  3. Payments to the agent count as payments to us only once the agent pays them to us. Payment for an agent Booking is a matter between the agent and us: if the agent does not pay us by the due date, we may cancel the Booking under Annexure 6, and the agent is responsible for telling you. Any claim for money you paid the agent is against the agent.
  4. Agents have no authority to change these Terms or make promises on our behalf beyond the Booking Confirmation.

3.6 Vehicle Category, not a specific vehicle. You book a Vehicle Category. Layout, colour, model year and minor equipment may differ from photographs (see clause 8.3 for substitutions).

3.7 Prices and dynamic pricing. Our direct rental prices may vary with demand, travel dates and how far in advance you book. The price stated in your Booking Confirmation is fixed for that Booking and will not change, except as set out in clause 3.8 or where you change the Booking.

3.8 Obvious pricing errors. If a price is so obviously wrong that you could not reasonably have believed it was correct (for example, a daily rate of R20 instead of R2,000), we may correct it before Collection. You may then accept the corrected price or cancel and receive a full refund.

4. Prices and what is included

4.1 Included in the daily rental: use of the Vehicle and its standard equipment (Annexure 5); Basic CDW; unlimited kilometres on agent and wholesale bookings, and on direct bookings of 5 days or more, subject to fair use (we may act if use is clearly excessive or abusive); direct bookings of fewer than 5 days include 220 km per rental day, with extra kilometres charged as set out in Annexure 3; VAT; access to our 24-hour assistance line; and a handover briefing.

4.2 Not included unless shown in your Booking Confirmation: Midi or Maxi CDW; Additional Drivers; one-way, transfer, after-hours, Sunday and public-holiday fees; cross-border documentation; optional extras; fuel; campsite, park, toll and border fees; and any charge that arises during the rental under Annexure 3.

4.3 How days are counted. Rental is charged per calendar day. The day of Collection and the day of return each count as a full day. Example: collecting on 1 March and returning on 10 March is 10 rental days.

4.4 Rate periods and rental length. Where a rental spans more than one rate period, each day is charged at the rate for the dates it falls in. The length band (for example, 8–28 days) is set by the total number of rental days.

4.5 Minimum rental. The minimum rental is 3 days, including over holidays and events, unless the Booking Confirmation states otherwise.

4.6 Currency and taxes. All prices are in South African rand (ZAR) and include VAT at the current rate. Namibian rentals are priced in ZAR; where we accept Namibian dollars, they are accepted at par. If the VAT rate or a government levy changes after your Booking is confirmed, the change applies to amounts not yet paid.

5. Payment

5.1 Booking deposit. To confirm a Booking you must pay a booking deposit of 50% of the total Rental Charges shown in your quotation. The booking deposit is part payment of the Rental Charges. If you cancel, the cancellation charge under clause 7 is deducted from what you have paid and the rest is refunded.

5.2 Balance. The balance is due no later than 30 days before Collection.

5.3 Late bookings. If you book within 30 days of Collection, the full amount is due on booking.

5.4 Events and groups. For Bookings of 5 or more vehicles, or rentals overlapping a major event listed in Annexure 3 (for example, Cape Epic or AfrikaBurn), the balance is due no later than 60 days before Collection, and the full amount is due on booking if made within 60 days.

5.5 If you do not pay on time. If the balance is not received by the due date, we will remind you in writing and give you 5 Business Days to pay. If you still do not pay, we may cancel the Booking, and clause 7 applies as though you had cancelled on the original due date.

5.6 Payment methods. We accept EFT and Visa or Mastercard credit or debit cards for Rental Charges. The Excess pre-authorisation requires a credit card (clause 11.1). We do not accept cash or cheques.

5.7 Bank and exchange costs. You pay your own bank’s charges and any currency conversion costs. Refunds are made in ZAR to the original payment method; we are not responsible for exchange-rate differences between payment and refund.

5.8 Chargebacks. If you reverse a card payment for an amount you owe under this Agreement, you remain liable for that amount and for any chargeback fee our bank charges us.

5.9 Refund timing. Refunds due to you are paid within 14 days of the event giving rise to the refund (for example, your cancellation, or a repair that cost less than the Excess we charged).

6. Changes to your Booking

6.1 You may ask to change your dates, Vehicle Category, locations or extras. Changes are subject to availability and our written confirmation.

6.2 Price on change. A confirmed change is priced at the rates applying on the date we confirm it.

6.3 Date changes. You may make one date change free of charge if you ask at least 60 days before the original Collection date and the new Collection date is within 12 months of it. Otherwise, moving your Collection date to a later date, or shortening the Rental Period, is treated as a cancellation of the affected days under clause 7, and the new dates as a new Booking.

6.4 Extensions during the rental. To extend, contact us at least 24 hours before the end of the Rental Period. An extension is valid only once we confirm it in writing and you have paid for it. Your CDW continues on the same terms during an agreed extension.

7. Cancellation by you

7.1 You may cancel a Booking at any time by written notice (email is sufficient) to us or, for agent Bookings, to your agent. The cancellation date is the date we or your agent receive your notice.

7.2 Cancellation charges. The following charges apply, calculated on the total Rental Charges for the cancelled Booking (excluding the Excess pre-authorisation):

Notice before Collection dateCancellation charge
90 days or more10%
60 to 89 days25%
30 to 59 days50%
8 to 29 days50%
7 days or less, or failure to collect (no-show)100%

7.3 Events and groups. Bookings under clause 5.4 follow the cancellation scale in clause 7.2; only the payment dates in clause 5.4 differ.

7.4 Re-hire credit. If you cancel within 29 days of Collection and we hire the same Vehicle Category to another customer for any of the cancelled days, we will reduce your cancellation charge by the rental we receive for those days, but not below 25% of the Rental Charges.

7.5 Death or hospitalisation. No cancellation charge is payable, and we will refund everything you have paid, if you cannot travel because the Renter, an Authorised Driver, or a member of their immediate family (spouse or partner, child, parent or sibling) has died or been admitted to hospital within 30 days before Collection. We may ask for reasonable proof, such as a death certificate or hospital letter. The same applies if we make a material change to your Booking that you do not accept (clause 8).

7.6 Late collection and early return. If you collect late or return early, the unused days are not refunded, except under clause 7.4 (if we re-hire the days) or clause 16 (breakdown).

7.7 Travel insurance. We recommend travel insurance that covers cancellation charges.

8. Cancellation, substitution or changes by us

8.1 If we cancel. If we cancel your Booking for any reason other than your breach, we will, at your choice, refund everything you have paid within 7 Business Days, or offer you an alternative Vehicle or dates. If we cancel fewer than 30 days before Collection for reasons within our control, we will also pay you 10% of the Rental Charges as compensation. We are not responsible for flights, accommodation or other travel costs you incur because we cancel.

8.2 Vehicle unavailable. If your booked Vehicle Category is not available at Collection, we will offer, in this order: (a) a Vehicle in a higher category at no extra cost; (b) a Vehicle in a lower category with a refund of the price difference; or (c) cancellation with a full refund. You may choose (c) instead of (b).

8.3 Substitutions. We may provide a different vehicle of the same or a higher Vehicle Category at no extra cost. If a substitute is materially different in a way that matters to your trip (for example, fewer berths, no shower, or a 2WD vehicle instead of a 4×4 for a 4×4-only route), you may decline it and clause 8.2 applies.

8.4 Refusal to rent. We may refuse to hand over the Vehicle if a driver does not meet clause 9, the Excess cannot be pre-authorised on the Renter’s credit card, the required identity documents are not produced, or a driver appears to be under the influence of alcohol or drugs. In these cases clause 7 applies as though you had cancelled on the Collection date, unless the reason is within our control.

9. Drivers

9.1 Who may drive. Only Authorised Drivers named in the Rental Agreement may drive the Vehicle. Every Additional Driver must be named and entered in the Rental Agreement at Collection, for the fee in Annexure 3. A person not named in the Rental Agreement may not drive the Vehicle.

9.2 Age and experience. Each Authorised Driver must be at least 21 years old for a Discoverer motorhome and at least 23 years old for a FunXA 4×4 camper, and must have held a full licence for at least 2 years. We do not make exceptions to the minimum age, and no fee or CDW option allows a younger driver.

9.3 Licences. Each Authorised Driver must produce, at Collection, an original, valid, physical driving licence for the class of Vehicle (for South African licences, code B (EB/08) or higher):

  1. a licence not in English or without a photograph must be accompanied by an International Driving Permit or an official English translation;
  2. photocopies, digital licences, learner’s licences and licences restricted in a way that affects driving the Vehicle are not accepted;
  3. each driver must also produce a passport or national identity document.

9.4 Vetting. We may ask for copies of licences and identity documents before Collection to verify them. We may refuse a driver whose licence or identity cannot be verified.

9.5 Your responsibility for drivers. You are responsible for the conduct of every person you allow to drive or use the Vehicle. Each Additional Driver who signs the Rental Agreement is jointly liable with you for amounts arising from their own driving.

9.6 Driving standards. Every driver must obey the traffic laws of each country travelled in, including speed limits and seat-belt and child-restraint rules; must not use a hand-held phone while driving; and must take adequate rest. We recommend no more than 8 hours’ driving a day, and less on gravel roads or in difficult conditions.

9.7 Passengers. The number of people travelling may not exceed the number of seat belts in the Vehicle, and never more than: Discoverer-4: 4; Discoverer-6: 6; FunXA 4×4: 2. Children must use a restraint suitable for their age and size as required by law.

10. Collection

10.1 When and where. Collection takes place at the Depot and time in your Booking Confirmation, during the Depot hours in Annexure 3. Allow about 1 hour for the handover briefing. Collection outside these hours is available only by prior arrangement and for the fee in Annexure 3.

10.2 What you need. The Renter and every Authorised Driver must attend with the documents in clause 9.3, and the Renter must present the credit card for the Excess pre-authorisation (clause 11).

10.3 Inspection. Before you drive away, we will inspect the Vehicle with you and record its condition, fuel, gas, water and equipment in the Collection Checklist (Annexure 5), with date-stamped photographs. You will receive a copy. Please point out anything you think we have missed.

10.4 What your signature means. By signing the Collection Checklist you confirm only that it records the condition of the Vehicle as you and we saw it at Collection. It is not an admission that the Vehicle is free of defects that could not reasonably be seen.

10.5 Defects found later. Please report any damage or fault not recorded in the Checklist within 24 hours of Collection, with photographs if possible. If you do, we will treat it as existing at Collection. Hidden mechanical defects may be reported at any time.

10.6 Late arrival. Tell us as soon as possible if you will be late. If you arrive after the Depot closes, Collection will take place on the next Business Day, and the missed day is not refunded (clause 7.6).

11. Excess held on your card

11.1 Amount. At Collection we pre-authorise the Excess for your CDW level (R65,000 on Basic, R30,000 on Midi, nil on Maxi) on a physical Visa or Mastercard credit card in the Renter’s name. Debit, prepaid and virtual cards are not accepted. The cardholder must be present at Collection with the card.

11.2 Purpose. The pre-authorisation secures the Excess and other amounts you may owe us under this Agreement, such as fuel, cleaning, equipment and late-return charges.

11.3 Other amounts. The Excess applies to each Incident. Amounts you owe beyond what is pre-authorised (for example, for a second Incident, or fines received later) are charged to your card under clauses 21 and 23.

11.4 Release. If the Vehicle is returned on time, with no Damage and nothing owing, we will instruct the release of the pre-authorisation within 7 days of return. Your bank may take longer to release it; we cannot control this.

11.5 Charges to your card. We may charge your card only for amounts that are (a) set out in Annexure 3, (b) the Excess or other amounts determined under clauses 18 to 21, or (c) amounts you have agreed. We will send you an itemised statement with supporting evidence when we charge.

11.6 Later charges. Fines received after return are charged to your card under clause 23.

12. Your responsibilities while using the Vehicle

12.1 General care. You must take reasonable care of the Vehicle and use it as a careful owner would, in line with the briefing, the in-vehicle manual and Annexure 4.

12.2 Daily checks. Before each day’s driving, check engine oil, coolant, tyre pressures (including the spare) and warning lights, as shown in the briefing. If a red warning light appears, or the engine overheats, stop safely, switch off the engine and call us.

12.3 Fuel. All our Vehicles run on diesel. Use only 10 ppm or 50 ppm diesel, as shown on the fuel sticker. If the wrong fuel is put in, do not start the engine and call us.

12.4 Security. Lock the Vehicle when unattended, close windows and roof hatches, and keep keys with you. Do not leave keys or documents in the unattended Vehicle.

12.5 Living systems. Use the gas, electrical, water, fridge and air-conditioning systems as shown at the briefing. In particular:

  1. turn gas off at the bottle when driving and when the Vehicle is unattended; and
  2. do not use the window air-conditioning unit or the microwave unless connected to mains power, where the Vehicle requires this.

12.6 Smoking, vaping and pets. Smoking and vaping are not allowed in the Vehicle. Pets are not allowed unless we agree in writing. If these rules are broken, the smoking odour fee in Annexure 3, or the actual cost of cleaning after a pet, applies.

12.7 Repairs and modifications. Do not repair, modify or add to the Vehicle except under clause 16.

12.8 Wear and tear. You are not responsible for fair wear and tear: normal deterioration from careful use, such as light scuffs on interior surfaces, normal tyre tread wear and stone chips smaller than 5 mm on paintwork. Annexure 5 gives further examples.

12.9 Night driving and overnight stops. Do not drive between sunset and sunrise, except short trips of up to 10 km on tarred roads from where you are staying overnight (for example, to a nearby restaurant or shop). Any other driving between sunset and sunrise means the CDW does not apply (clause 20.2). Stay overnight only at campsites or other established accommodation, never at the roadside.

13. Prohibited use

The Vehicle must not be used:

  1. by anyone who is not an Authorised Driver;
  2. by a driver under the influence of alcohol above the legal limit, or of drugs or medication that impair driving;
  3. to carry passengers or goods for payment, or for any commercial purpose, unless we agree in writing;
  4. to tow or push any vehicle, trailer or object, unless we agree in writing;
  5. in any race, rally, speed test or similar event;
  6. on any road or in any area prohibited for that Vehicle in Annexure 4;
  7. outside the countries permitted for that Vehicle without our written approval under clause 15;
  8. for any illegal purpose, including transporting illegal goods;
  9. when the Vehicle is overloaded beyond its legal weight limit or carrying more people than it has seat belts;
  10. when the driver knows, or should reasonably know, that the Vehicle is unsafe to drive; or
  11. on any 4×4 trail, off-road park or leisure track made for testing off-road ability, whether or not it charges an entrance fee.

14. Where you may drive

14.1 Vehicle-specific rules. Annexure 4 sets out, for each Vehicle Category: the countries where it may be driven, countries needing our prior approval, prohibited countries, the road types it may use and named prohibited routes.

14.2 Roads. Unless Annexure 4 says otherwise:

  1. tarred public roads are permitted;
  2. maintained gravel roads open to public traffic, such as numbered provincial and district gravel roads and roads to established campsites, lodges and national-park rest camps, are permitted at a speed suitable for the conditions and not above the speed in Annexure 4; and
  3. 4×4 tracks, beaches, dunes, riverbeds, flooded roads and roads closed to the public are prohibited for all Vehicles.

14.3 Changing conditions. We may tell you before or during your rental that a road or area is temporarily prohibited because of weather, flooding, unrest or safety. We will tell you in writing (including by text message or email). A temporary restriction applies from the time you receive our notice.

14.4 Height and width. Check overhead clearance before driving under any bridge, tree, roof, archway or fuel-station canopy. The height of your Vehicle is shown in Annexure 4 and explained at the handover.

15. Cross-border travel

15.1 Approval. You may take the Vehicle out of the country of Collection only to countries listed for it in Annexure 4, and only with our written approval obtained before Collection. Please request approval at least 14 days before Collection. Approval and the cross-border fee in Annexure 3 apply to every border crossing, including into Lesotho and Eswatini.

15.2 What we provide. For approved travel we will provide the vehicle registration documents and a letter of authority from the owner and any financier, for the cross-border documentation fee in Annexure 3.

15.3 What you arrange yourself. We provide only the Vehicle’s cross-border documents (registration papers and letter of authority), for the fee in Annexure 3. Everything else is your responsibility, including passports, visas, travel and medical insurance, and any border fees, road levies, third-party insurance or permits charged at the border.

15.4 Additional excess. For some countries an additional Excess applies on top of your CDW Excess, as shown in Annexure 2.

15.5 Breakdowns and accidents outside South Africa and Namibia. Assistance and replacement vehicles outside South Africa and Namibia may take longer to arrange and may not be available in remote areas. Clause 16.6 applies.

15.6 Return. The Vehicle must be returned to the Depot in the Rental Agreement. One-way rentals across a border are available only where we agree them in the Booking Confirmation.

16. Breakdowns and roadside assistance

16.1 Call us first. If the Vehicle breaks down or develops a fault, stop safely and call the 24-hour technical assistance number for your Depot: Johannesburg +27 82 940 0984; Cape Town +27 82 908 1252; Windhoek +264 81 141 2975. The numbers are also in your Rental Agreement and in the Vehicle (Johannesburg office: +27 11 395 1020). Follow our reasonable instructions.

16.2 Small repairs. You may arrange repairs costing up to R1,200 (including VAT) without our approval. For anything more, you must get our approval first; we will give you a reference number. Keep original receipts and replaced parts. We will refund approved repair costs on the day of return, on presentation of the receipts, unless clause 16.7 applies.

16.3 Towing. Do not allow the Vehicle to be towed except by a provider we appoint or approve, unless there is an immediate safety risk.

16.4 What we will do. If the Vehicle cannot be driven safely because of a mechanical fault that you did not cause, we will, at our choice and as soon as reasonably possible:

  1. arrange a repair, usually within 24 hours of your call in South Africa and Namibia; or
  2. provide a replacement Vehicle of the same or a higher category, at a place we agree with you; and
  3. if you cannot use the Vehicle overnight while we do this, refund reasonable accommodation costs up to R1,500 per night for up to 2 nights, on presentation of receipts.

16.5 Refund for lost days. If the Vehicle cannot be used for more than 24 hours, counted from when you tell us about a mechanical fault you did not cause, we will refund the daily rental for each full day lost, or, if we cannot repair or replace the Vehicle within a reasonable time, the Rental Charges for the unused part of the Rental Period. This is in addition to clause 16.4(3). We do not reimburse telephone costs.

16.6 Remote areas and outside South Africa and Namibia. Response times are longer in remote areas and outside South Africa and Namibia, and a replacement may only be available at the nearest town or border post. Clauses 16.4 and 16.5 still apply, measured against what is reasonably possible in that location.

16.7 Faults you cause. If the fault was caused by misuse, a breach of clauses 12 or 13, or an Incident, clauses 16.4 and 16.5 do not apply. Repair, recovery and replacement costs are dealt with under clauses 18 to 21.

16.8 Comfort items. Items such as the air-conditioner, cruise control, microwave, hot-water system, gas appliances, radio, interior lights and USB sockets are comfort items. If one fails, we will make reasonable efforts to repair it; this can take up to two days, or longer in remote areas and outside South Africa. If it cannot be repaired, you are not entitled to a replacement Vehicle or compensation. Failure of an essential living system (fridge, water supply or bed) is treated as a mechanical fault under clause 16.4. We are not responsible for damage or claims arising from fast or long-distance driving on corrugated (washboard) gravel roads.

16.9 Tyres. Punctures are your responsibility to repair, unless you have CDW Maxi. A replacement tyre must match the original in size and load rating; retreads and part-worn tyres are not accepted. Maxi covers no more than two replacement tyres per rental.

17. Accidents, theft and damage — what to do

17.1 At the scene. If there is an accident, theft, break-in or other Incident:

  1. make the scene safe and call emergency services if anyone is injured;
  2. call the 24-hour number for your Depot (clause 16.1) as soon as reasonably possible;
  3. take photographs and video of the scene, all vehicles and any damage;
  4. record the names, addresses, phone numbers, licence and registration details and insurers of others involved, and of witnesses;
  5. do not admit fault or agree to pay anyone, other than as required by law; and
  6. do not abandon the Vehicle; secure it as best you can.

17.2 Police. Report every accident involving another person, vehicle or property, and every theft or break-in, to us and to the police within 24 hours, and obtain a case or reference number.

17.3 Accident report. Complete our accident report (or, for a theft or break-in, our incident report) fully and truthfully within 24 hours, and give us any documents about the Incident you receive. Cooperate with us and our claims assessors, including by providing a statement or affidavit if reasonably requested.

17.4 Late reporting. If you do not report an accident to us and to the police within 24 hours, the CDW does not apply and you are liable for the full cost of the Damage under clause 18.4, unless you could not reasonably have reported it in time (for example, because you were in hospital or had no means of communication).

17.5 Replacement after an Incident. If the Vehicle cannot be driven after an Incident, we will try to provide a replacement Vehicle from the nearest Depot, subject to availability. You must first pay the applicable Excess, and the delivery cost in Annexure 3 if a Serious Exclusion applies. The replacement is issued on a new Rental Agreement, with its own Excess pre-authorised in full for the CDW level you choose. If no replacement is available, or you decline one, we will refund the Rental Charges for the unused days, less any amounts you owe us.

18. Your financial responsibility for Damage

18.1 General rule. From Collection until we accept the Vehicle back, you are responsible for Damage to the Vehicle, whatever its cause, except Damage caused by us, a defect in the Vehicle or fair wear and tear.

18.2 Limited by your CDW. For each Incident, your responsibility for Damage is limited to the Excess for your CDW level (Annexure 2). If the CDW does not apply, clause 18.4 sets the limit.

18.3 What you pay when the CDW applies. For each Incident you pay up to the Excess. When the Damage is reported, we charge the full Excess to your card; once the repair is done, we refund the difference if the reasonable cost of repair was less than the Excess. You also pay the claims administration fee in Annexure 3 where you or an Authorised Driver were at fault. You do not pay loss of use or diminution in value for an Incident covered by your CDW. Towing and recovery after an accident you cause are for your account whatever CDW you choose (clause 20.4).

18.4 What you pay when the CDW does not apply. Where clause 20.2 or 20.3 applies, the CDW does not apply, whatever option you chose (including Maxi). You must then pay the following, up to a total of R65,000 per Incident (the Basic Excess):

  1. the reasonable cost of repairing the Vehicle; or, if repair is uneconomical, its market value immediately before the Incident (based on a recognised vehicle valuation guide for the model and year, adjusted for the habitation conversion), less salvage;
  2. reasonable towing, recovery and storage costs actually incurred;
  3. loss of use for the days the Vehicle is out of service, at 50% of the daily rate, for no more than 30 days; and
  4. the claims administration fee in Annexure 3.

18.5 Third-party Damage. Your liability for damage to other people’s property and for injury to other people is dealt with in clause 22.

18.6 More than one Incident. The Excess applies separately to each Incident.

19. Collision Damage Waiver (CDW)

19.1 What it is. With CDW, the most you pay for Damage to the Vehicle in an Incident is your Excess; we waive the rest, on the terms in this Agreement and Annexure 2. CDW applies only to Damage to the Vehicle. It does not extend to injury to any person, personal belongings or claims by third parties.

19.2 Options. Basic CDW is included in every rental. You may choose Midi or Maxi for a daily charge. The options, Excesses, inclusions and minimum rental periods are set out in Annexure 2.

19.3 Choosing your CDW. You choose your CDW when booking or, at the latest, at Collection. You cannot upgrade or downgrade after Collection.

19.4 Corporate renters. A corporate renter with a Bobo corporate account may decline the CDW if it has signed our self-insurance agreement and given us written proof from its insurer that rented vehicles are comprehensively insured to our reasonable satisfaction.

20. When the CDW does not apply

20.1 How this clause works. The CDW protects you in almost all accidents, including those caused by an ordinary driving mistake. It does not apply in the situations below, or where clause 17.4 applies. In clause 20.2 CDW is lost whenever the situation exists. In clause 20.3 CDW is lost only where the situation caused or contributed to the Damage. Clause 20.4 lists what is never covered, or covered only by CDW Maxi. Where the CDW does not apply, clause 18.4 limits what you pay to R65,000 per Incident.

20.2 Serious Exclusions. The CDW does not apply to any Damage occurring while:

  1. the Vehicle is driven by a person who is not an Authorised Driver;
  2. the driver is under the influence of alcohol above the legal limit, or of drugs or medication that impair driving, or refuses a lawful breath or blood test;
  3. the Vehicle is in a country not permitted for it in Annexure 4, or one for which we have not given written approval under clause 15;
  4. the Vehicle is being driven between sunset and sunrise, other than a short trip allowed by clause 12.9;
  5. the Vehicle is being used for a prohibited purpose under clause 13(3), (5) or (8);
  6. the Damage is caused deliberately by an Authorised Driver or passenger; or
  7. the Damage results from a theft where the keys were left in or on the unattended Vehicle;

or where you obtained the rental or made a claim by giving us false information, or by fraud.

20.3 Exclusions that apply where they caused or contributed to the Damage. The CDW does not apply to Damage caused or contributed to by:

  1. driving on a road or in an area prohibited for the Vehicle in Annexure 4 or in a notice under clause 14.3;
  2. driving recklessly, or at a speed more than 30 km/h above the speed limit or above the maximum speed for gravel roads in Annexure 4;
  3. a roll-over, meaning an Incident in which the Vehicle overturns or rolls, whatever position it comes to rest in, where the driver lost control through their own fault;
  4. continuing to drive after a red warning light, overheating, or an obvious mechanical problem appears;
  5. putting the wrong fuel in the Vehicle, or water or other substances in the fuel tank;
  6. incorrect use of the gearbox, clutch, handbrake or 4×4 system, where shown by the condition of the parts;
  7. towing or pushing without our approval, or overloading.

20.4 Never covered by any CDW. Whatever CDW you choose, you are responsible for the reasonable cost of:

  1. damage caused by driving through water or by water entering the engine, or by salt water;
  2. loss of or damage to equipment and accessories (charged under Annexure 3);
  3. tyres, rims and windscreens, unless you have CDW Maxi (no more than two tyres per rental);
  4. interior damage such as burns, stains, tears and odours (charged under Annexure 3);
  5. towing and recovery after an accident or Incident you cause, and any damage caused while towing (towing must be by a provider we appoint or approve, to the nearest Depot or repairer we name); towing after a mechanical failure you did not cause is dealt with under clause 16;
  6. lost, damaged or locked-in keys (charged at actual cost under Annexure 3); and
  7. your personal belongings.

20.5 Additional Excess for some countries. An additional Excess applies in the countries marked in Annexure 2 and 4. It applies on top of the Excess for your CDW level.

21. Assessing and charging Damage

21.1 Inspection on return. We inspect the Vehicle with you at return and record any new Damage in the Return Checklist, with photographs. If you return the Vehicle outside Depot hours or without a joint inspection, we inspect it on the next Business Day and send you the photographs.

21.2 Damage found after return. We may charge you for Damage found after return only if we notify you within 3 Business Days of return, with photographs, and it is not Damage that could have happened after return.

21.3 How we work out the charge. We charge the reasonable cost of repair based on (a) a quotation from an independent repairer or our own workshop at rates no higher than an independent repairer’s, (b) an assessor’s report for repairs above R20,000, or (c) the item prices in Annexure 3. We will give you a copy of the quotation, report or invoice. Only we or a repairer we appoint may repair the Vehicle.

21.4 Payment on return. Damage is assessed at the return inspection, and the amount due (up to your Excess, or under clause 18.4) is charged to your card on the day of return. You authorise us to charge your card for amounts due under clauses 18 to 21, and we will send you the evidence in clause 21.3.

21.5 Fair charges only. We will not charge you for Damage that was recorded at Collection, that is fair wear and tear, or for which we cannot show reasonable evidence.

22. Third parties, injury and belongings

22.1 Third-party claims. We maintain arrangements for third-party claims arising from the use of our Vehicles in South Africa and Namibia up to R5 million per Incident. You are not responsible for a third-party claim to the extent it is met under those arrangements, except where a Serious Exclusion applies.

22.2 Third-party claims against us. If a third party claims against us because of the use of the Vehicle during the Rental Period, you must pay us the amount of that claim that is not met under those arrangements, but only to the extent the claim arose from the act or omission of you, an Authorised Driver or a passenger, and not from our own negligence.

22.3 Personal injury and belongings. No CDW covers injury to you or your passengers, medical costs, or loss of or damage to personal belongings. We strongly recommend travel insurance covering medical costs, personal liability, belongings and cancellation.

22.4 Road Accident Fund. Claims for injury from road accidents in South Africa may fall under the Road Accident Fund Act; this is outside our control.

23. Fines and infringements

23.1 You are responsible for all traffic, parking and speed-camera fines incurred during the Rental Period. Toll fees are paid at the toll gate.

23.2 When we receive a notice for an infringement during your Rental Period, we will, where the law allows, nominate the driver to the authority so that the notice is redirected to you. Where we must pay it ourselves, we will charge you the amount paid plus the administration fee in Annexure 3, and send you a copy of the notice.

23.3 Notices can arrive several months after your rental. You authorise us to charge your card for these amounts after sending you a copy of the notice.

24. Return of the Vehicle

24.1 When and where. Return the Vehicle to the Depot and by the date and time in the Rental Agreement, during Depot hours, and allow about 30 minutes for the return inspection. The latest return time is 16:00, or 15:00 if you want to leave luggage at the Depot. Returns outside Depot hours are allowed only by prior arrangement and for the fee in Annexure 3.

24.2 When the Rental Period ends. The Rental Period ends when we have inspected the Vehicle with you and accepted the keys, or, for an agreed after-hours return, at the start of the next Business Day.

24.3 Condition on return. Return the Vehicle:

  1. with the fuel at the same level as at Collection;
  2. with the gas bottle(s) full;
  3. with the interior swept, dishes washed and rubbish removed;
  4. with the toilet cassette emptied and clean (Discoverer-4 and Discoverer-6); and
  5. with all equipment listed in the Collection Checklist.

If you do not, the charges in Annexure 3 apply.

24.4 Late return. If you will be late, call us. A grace period of 60 minutes applies. After that, each started day of late return is charged at the full daily rate on your Booking. If your late return causes us to compensate the next customer, you must also pay the reasonable, documented cost of that compensation, up to R5,000.

24.5 Not returned. If the Vehicle is not returned within 24 hours of the end of the Rental Period and you have not contacted us, we may treat it as stolen, report it to the police, and recover it. You must pay the reasonable costs of recovery.

24.6 Early return. If you return the Vehicle early, clause 7.6 applies.

25. Our liability to you

25.1 What we are responsible for. We are responsible for providing a Vehicle that is safe, roadworthy, in good working order and reasonably suitable for the trip described in your Booking, and for loss or damage you suffer that is a reasonably foreseeable result of our breach of this Agreement or our negligence.

25.2 What we are not responsible for. We are not responsible for:

  1. loss that was not reasonably foreseeable when the Booking was made;
  2. business losses, if you rent for a business purpose; or
  3. loss caused by you, an Authorised Driver, a passenger, a third party not acting for us, or an event under clause 27.

25.3 Limit. Except for death, personal injury, fraud, our gross negligence or any liability that cannot by law be limited, our total liability to you under this Agreement is limited to the total Rental Charges paid for the Booking, plus reasonable accommodation and transport costs under clause 16.

25.4 Your statutory rights. Nothing in this clause limits your rights under sections 54 to 56 and 61 of the CPA, where they apply.

26. Ending the rental for breach

26.1 When we may end it. We may end the rental and take back the Vehicle if:

  1. a Serious Exclusion event occurs or is reasonably suspected;
  2. you fail to pay an amount due within 3 Business Days of our written demand;
  3. the Vehicle is abandoned, or is used in a way that puts people or the Vehicle at serious risk; or
  4. you commit another material breach and do not remedy it within a reasonable time after we notify you, where it can be remedied.

26.2 What happens next. We will tell you why. You must return the Vehicle or allow us to collect it. You are not entitled to a refund of unused rental days, and you must pay the reasonable costs of recovery and any other amounts you owe us. We are not obliged to provide another vehicle.

26.3 Collection costs. If you do not pay what you owe us, you must also pay the reasonable costs we incur to collect it, such as debt-collection and legal fees.

27. Events outside anyone’s control

27.1 Meaning. An event outside a party’s reasonable control, such as a natural disaster, flood, fire, war, unrest, epidemic, border closure or government order, that could not reasonably have been avoided.

27.2 If we cannot provide the rental. If such an event prevents us from providing the Vehicle, we will refund all amounts paid within 7 days, or, if you prefer, move your Booking to new dates.

27.3 If you cannot travel. If such an event prevents you from travelling to collect the Vehicle (for example, a border closure or flight ban), we will, instead of the cancellation charge in clause 7, give you a credit for 100% of amounts paid, valid for 12 months, or, if you give us a valid reason for not accepting a credit, refund amounts paid less our reasonable, documented costs incurred.

27.4 During the rental. If such an event interrupts your rental, we will help you get the Vehicle to safety and work with you on a fair adjustment of the Rental Charges.

28. Your personal information

28.1 Privacy Notice. We process personal information in line with the Protection of Personal Information Act 4 of 2013 (“POPIA“) and our Privacy Notice at bobocampers.com/privacy-policy, which explains what we collect, why, who we share it with, how long we keep it and your rights.

28.2 What we use it for. We use your and each driver’s personal information to make and manage your Booking, verify identity and licences, prevent fraud, provide assistance, manage incidents and claims, deal with fines and comply with the law. We share it only as needed with your agent, our insurers and assessors, roadside and repair providers, traffic and police authorities, payment providers and professional advisers.

28.3 Marketing. We will send you marketing only if you opt in, and you may opt out at any time.

28.4 Outside South Africa. Some of our booking and payment providers store information outside South Africa, and Windhoek rentals involve processing in Namibia. We transfer information only with the safeguards POPIA requires.

28.5 Vehicle tracking. Our Vehicles do not currently have tracking devices. If the Vehicle you rent has one, we will tell you before Collection, and we will use its data only to locate and recover the Vehicle, assist you in an emergency when you ask us to, investigate Incidents and claims, and maintain the fleet. We do not monitor it continuously and you must not rely on it for your safety.

28.6 Immobilisation. Where a Vehicle has a tracking device, we will immobilise it remotely only where it has been reported stolen, is used outside permitted countries, or has not been returned under clause 24.5, and only in a way designed to prevent restarting rather than stopping a moving vehicle.

29. Complaints, governing law and courts

29.1 Complaints. Please send complaints to [email protected], with your booking reference. We will acknowledge them within 2 Business Days and respond in full within 4 Business Days.

29.2 Escalation. If you are not satisfied, you may refer the matter to the Consumer Goods and Services Ombud or the National Consumer Commission, or to a court with jurisdiction. Nothing in this Agreement prevents you from doing so.

29.3 Governing law. South African law governs this Agreement. For rentals collected in Windhoek, any mandatory Namibian law also applies.

29.4 Courts. You and we agree that disputes will be heard in the courts of Gauteng, South Africa, unless the law gives you the right to bring proceedings in another court (for example, where you live).

30. General

30.1 Whole agreement. The Agreement contains everything agreed between us about the rental. This does not exclude liability for statements we made that you relied on in deciding to book, or your rights under the CPA.

30.2 Changes. A change to this Agreement for your Booking is valid only if confirmed in writing by both parties (email is enough).

30.3 Notices. We send notices to the email address and phone number in the Rental Agreement. You send notices to [email protected] or to the Depot. Notices by email are received when sent, unless the sender receives a delivery failure message.

30.4 Electronic signature. The Agreement may be accepted and signed electronically, and an electronic copy is as valid as the original.

30.5 Transfer. You may not transfer the Agreement or the Vehicle to anyone else. We may transfer our right to receive payment to a financier or collection agent, without reducing your rights.

30.6 Severability. If a court finds any part of the Agreement invalid, the rest remains valid.

30.7 No waiver. If we do not charge or enforce something straight away (for example, a fine or a damage charge), we can still do so later.

30.8 Language. The Agreement is in English. A translation, if provided, is for convenience only.
